(DailyNewsUg) Masaka High court has nullified the election of ruling party NRM’s Richard Kyabaggu as Kalungu district local council (LC5) chairperson.
Justice Lawrence Gidudu nullified the election and ordered the Electoral Commission to conduct fresh elections. Gidudu ruled that Kyabaggu was gifted electoral victory after a fraudulent tallying process.
Former chairman Emmanuel Musoke (Democratic Party) petitioned court seeking nullification of Kyabaggu’s election on grounds that he was declared winner in error.
Musoke said he was the rightful winner in the polls but Electoral Commission declared his rival despite the fact that he obtained more votes. According to Musoke, EC officials falsified declaration of results forms.
He identified four polling stations where he alleged forgery of declaration forms. The polling stations are Kalumaga-Kitawuluzi, Yesu Akwagala, and Bugomola polling station.
Justice Gidudu concurred with the petitioner Musoke saying he had proved beyond reasonable doubt that he was denied victory.
He noted that throughout the interrogation of results from the four contested polling stations, he found out that the declaration forms inserted in the ballot boxes were strange.
He noted that the declaration forms did not have security marks and were lighter than the original forms provided to the candidates. He observed that it is clear that the national electoral body forged these declaration forms to gift the NRM party candidate Kyabaggu with victory.
Kyabaggu and his lawyer Geoffrey Kandebe were not in court. Musoke, who was accompanied by his supporters said he was disappointed with the court ruling.
He noted that he wanted court to declare him winner since he had successfully argued his case. Musoke said he’s considering appealing the court ruling so that he secures automatic declaration.
